Punjab & Haryana High Court, Chandigarh

Quashing of FIR

A quashing petition asks the High Court to set aside an FIR or the proceedings arising from it. It is not an appeal — it invokes the court's inherent power to prevent abuse of process.

How it ordinarily proceeds.

The usual course is set out below. Individual matters vary with the facts, the sections invoked and the court's board.

  1. 01
Assessing the groundsNot every FIR is fit for quashing. The common grounds are that the allegations disclose no offence, that the dispute is civil in substance, or that the parties have compromised.
  2. 02
Compromise, where applicableIn matrimonial and commercial disputes, a settlement between the parties is often the basis. The compromise is recorded and placed before the court.
  3. 03
Drafting the petitionThe petition annexes the FIR, the settlement if any, and sets out why continuing the proceedings would serve no purpose.
  4. 04
Filing at ChandigarhThe petition is filed before the Punjab & Haryana High Court. The complainant and the State are respondents.
  5. 05
Verification of the settlementWhere a compromise is relied on, the High Court commonly directs the parties to appear before a lower court or officer to verify it.
  6. 06
Final hearingOn being satisfied, the High Court quashes the FIR and the proceedings arising from it.

Common questions

Questions that come up.

Can a serious offence be quashed on compromise?

The court draws a distinction between offences that are private in character and those with a wider public dimension. Heinous offences are generally not quashed merely because the parties have settled.

Does quashing require the complainant's cooperation?

Where the ground is a settlement, yes — the complainant must appear and affirm it. Where the ground is that no offence is disclosed on the face of the FIR, it does not.

Is quashing possible after the charge sheet is filed?

Yes. The inherent power extends to quashing proceedings at any stage, including after the charge sheet and during trial.

How long does a quashing petition take?

It depends on the High Court's board and on whether verification of a compromise is directed. These are not short proceedings and the timeline should be discussed at the outset.
